How do we protect you – criminal complaints?

Not infrequently, a legal entity may become subject to criminal liability. If offences are committed in connection with the company, it may be fined or, in serious cases, dissolved.

When a legal entity was established for the purpose of committing crimes or when its object or activity was diverted for this purpose, the most severe complementary penalty shall apply, namely, the dissolution of the legal entity.

Where and when can I report a crime?

If you choose to file a verbal complaint, you must go to the police station. The police officer will write down the complaint, record it, and ask you to sign it. Written complaints must also be signed by you.

The complaint must include your first and last name, occupation, address, and a detailed description of the facts. If the name of the offender is known, it must be included in the complaint, as well as any evidence related to the incident. During the criminal investigation, the victim may add further evidence to the case file.

At the police station, you will find standard forms to help you write your complaint. These are not mandatory, but are intended to guide you when writing your complaint.

The complaint must be written in Romanian. If you do not speak Romanian, you will be provided with a free interpreter to assist you in this process.

After you have filed your complaint, you will be given a registration number by the police.

When the case reaches the Public Prosecutor's Office, it will be given a new registration number.

How can I get involved?

You can choose to participate only as a witness.

In this case, the police or prosecutor handling the case will call you in for questioning and ask for as much detail as possible about the incident.

If you are the injured party, you must submit a request to the criminal investigation body, which will ask you for a detailed description of the facts and ask you to present the evidence you have.

The police officer will draw up a report which you will be asked to sign and which will remain as evidence in the case file.

If you wish to claim damages or other compensation from the accused, you must bring a civil action or join the criminal proceedings as a civil party.

You can file a request to participate in the trial as an injured party and/or civil party at any time during the criminal investigation.

As an injured party or civil party, you have the right to receive information about the progress of the investigation and a copy of the prosecutor's decision containing information about the appropriateness of bringing the case to court.

You can request reimbursement of court costs.

  • If you have joined the proceedings as a civil party, you will only be reimbursed for your costs if the case goes to court and the offender is found guilty (the court will order the defendant to reimburse your costs).
  • If you participated in the trial as an injured party, the court will decide what part of the costs will be reimbursed and by whom.

Regardless of your role in the various stages of the criminal proceedings, you will be provided with a free interpreter if you do not speak Romanian.

You can also benefit from the services of a lawyer during criminal proceedings. If you cannot afford a lawyer, you will be provided with free legal assistance.
